Welcome to Parallux Fragrances (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related features, tools, content, products, and services (collectively, the “Services”). Parallux Fragrances operates this site on the Shopify platform to provide you with a curated fragrance-shopping experience.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy (which can be found on our website). If you do not agree, please do not use the Services.

1. ELIGIBILITY & ACCOUNT ACCESS

You represent that you are at least the age of majority in your province, state, or country of residence and have authority to enter into these Terms.
If you are under the age of majority, a parent or legal guardian must read and accept these Terms on your behalf and is responsible for your use of the Services.

To purchase through our store, you may need to create an account or provide personal information (name, email, billing, and shipping details). You warrant that all information is current, accurate, and complete, and you are solely responsible for safeguarding your login credentials and all activity under your account.

We reserve the right to suspend or terminate any account that we believe has been compromised or is used in violation of these Terms.

2. OUR PRODUCTS & INTELLECTUAL PROPERTY NOTICE

Parallux Fragrances offers original interpretations inspired by well-known designer scents.
We are not affiliated with, endorsed by, or associated with any designer brands, and all trademarks referenced remain the property of their respective owners.
Any reference to a brand name is for descriptive and comparison purposes only and does not imply imitation or infringement.

All product descriptions, visuals, and pricing are subject to change without notice. Colors and appearances may vary depending on device display and settings. We do not warrant that the quality or appearance of products will meet your expectations.

All formulations are independently created and produced in facilities that comply with IFRA standards and Health Canada Cosmetic Regulations.

3. ORDERS & FRAUD PREVENTION

Your order constitutes an offer to purchase, which we may accept or decline at our sole discretion. An order is considered accepted only when payment is processed and you receive an order-confirmation email.

We reserve the right to:

  • Verify orders for accuracy or authenticity.

  • Cancel or refuse any order suspected of fraud, unauthorized payment use, or abnormal order volume.

  • Limit or prohibit orders placed by distributors, resellers, or dealers.

If an order is canceled after payment, we will refund the full amount to your original payment method.

4. PRICING & BILLING

All prices are listed in Canadian dollars (CAD) unless otherwise stated and exclude applicable taxes, shipping, duties, or import fees.
You agree to provide valid payment information and authorize us (or Shopify Payments) to charge your chosen method for the total amount due.

Prices, discounts, and promotions may change without notice. We are not responsible for pricing errors, typographical mistakes, or expired promotions, and we may cancel any order affected by such errors.

Customers are responsible for any customs duties, import taxes, or brokerage fees applicable to international shipments.

5. SHIPPING & DELIVERY

Orders are processed within our stated timelines but shipping times vary by destination. Delivery dates are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, weather, or events beyond our control.

Risk of loss and title transfer to you once the order is handed to the carrier. We are not responsible for lost or stolen packages after carrier confirmation of delivery.
Please ensure your shipping address is accurate; reshipments due to incorrect addresses may incur additional charges.

6. RETURNS & REFUNDS (TRY RISK-FREE POLICY)

We want you to love your fragrance. If you are not satisfied, you may request a refund or exchange within 14 days of receiving your order.

Return Conditions

  • Bottle must be at least 90 % full and in original packaging.

  • You must provide a clear photo of the item before return authorization.

  • Shipping costs are non-refundable.

  • Refunds will be issued to the original payment method once the item is received and verified.

We may refuse returns that do not meet these conditions. Gift cards are non-refundable. Returned items may be donated to charity partners in accordance with sustainability practices.

7. INTELLECTUAL PROPERTY

All materials on the Services—including text, graphics, images, video, audio, design, trademarks, and layout—are owned by Parallux Fragrances or its licensors and protected under Canadian and international copyright and trademark laws.

You may use the Services for personal, non-commercial purposes only. Reproduction, modification, distribution, or any other use without written consent is prohibited. All rights not expressly granted are reserved.

8. THIRD-PARTY TOOLS & LINKS

We may provide access to third-party tools or websites (“Third-Party Services”). These are provided as is and as available without warranty or endorsement. Your use of such Third-Party Services is entirely at your own risk and governed by the respective providers’ terms and privacy policies. We are not liable for any damages or losses resulting from your use of them.

9. RELATIONSHIP WITH SHOPIFY

Parallux Fragrances is powered by Shopify, which hosts our store and processes payments. All sales are made directly with Parallux Fragrances. Shopify is not a party to your transactions and bears no responsibility for any resulting loss, injury, or claim. By purchasing from us, you expressly release Shopify and its affiliates from all liabilities arising out of your transactions with Parallux Fragrances.

10. PRIVACY

Your personal information is handled in accordance with our Privacy Policy(available to view on our website) and Shopify’s Privacy Policy. By using the Services, you consent to the collection and use of information as described in those policies.

11. CUSTOMER FEEDBACK & CONTENT

Any suggestions, reviews, comments, ideas, or materials you submit (“Feedback”) become non-confidential and may be used by Parallux Fragrances under a perpetual, worldwide, royalty-free license to use, modify, publish, and display such Feedback for any purpose. You represent that you own all rights to the Feedback and that it does not violate any third-party rights or laws.

We may remove or edit content that we consider unlawful, offensive, or misleading. You agree not to post defamatory, obscene, or infringing material or to impersonate others when submitting content.

12. ERRORS & OMISSIONS

Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions related to pricing, descriptions, or availability. We reserve the right to correct such errors, update information, or cancel orders affected by them without prior notice, including after you have submitted an order.

13. PROHIBITED USES

You may not use the Services for any unlawful purpose or in any way that could harm Parallux Fragrances, Shopify, or others. Prohibited activities include but are not limited to:

  • Uploading viruses or malicious code.

  • Collecting personal information of others.

  • Harassment, abuse, or infringement of intellectual-property rights.

  • Sending spam or engaging in scraping, crawling, or automated data gathering.
    We may suspend or terminate access for any violation.

14. TERMINATION

We may terminate or suspend your access to the Services at any time, without notice, for conduct we believe violates these Terms or applicable law. You remain liable for all amounts due up to the date of termination. Sections relating to Intellectual Property, Feedback, Limitation of Liability, Indemnification, and Governing Law survive termination.

15. DISCLAIMER OF WARRANTIES

Except as expressly stated by Parallux Fragrances, the Services and all products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, durability, or non-infringement. We do not guarantee uninterrupted or error-free operation.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Parallux Fragrances, Shopify, and their affiliates, directors, officers, employees, or agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, or data, arising out of your use of the Services or products.

Maximum Liability Cap: In no event shall Parallux Fragrances’ total aggregate liability exceed CAD $100 (or the amount you paid for the product giving rise to the claim, whichever is less).

Some jurisdictions do not allow certain limitations; in those cases, liability shall be limited to the maximum extent permitted by law.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Parallux Fragrances, Shopify, and their affiliates, officers, directors, employees, and agents from any claim, loss, damage, or expense (including reasonable attorneys’ fees) arising out of your (i) breach of these Terms, (ii) violation of any law or third-party right, or (iii) use of the Services or products.
We may assume control of the defense of any matter subject to indemnification at your expense.

18. FORCE MAJEURE

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, wars, strikes, labor disputes, transportation interruptions, governmental restrictions, or power failures. Performance will resume once the event has ended.

19. CLASS ACTION WAIVER & JURY TRIAL WAIVER

To the fullest extent permitted by law, you agree that any dispute will be resolved on an individual basis and not as part of any class, collective, or representative action.
You further waive any right to a trial by jury in any proceeding arising out of or relating to these Terms or your use of the Services.

20. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall continue in full force and effect.

21. WAIVER & ENTIRE AGREEMENT

Failure to enforce any provision shall not constitute a waiver. These Terms, together with our Privacy Policy and any other posted policies, constitute the entire agreement between you and Parallux Fragrances regarding your use of the Services and supersede all prior communications.

22. ASSIGNMENT

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign these Terms without notice.

23. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. You consent to the exclusive jurisdiction of the courts located in Alberta for any disputes, except where prohibited by law.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith by contacting info@paralluxfragrances.com.

24. HEADINGS

Section headings are for convenience only and do not affect interpretation.

25. CHANGES TO TERMS OF SERVICE

We may update these Terms at any time by posting a revised version on our website. Material changes will be communicated as required by law. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
